【裁判】「退職で損害」と2000万円の賠償請求訴訟を起こされた会社員　逆に会社を訴えて1100万円

退職を申し出ると、会社から「損害賠償請求するぞ」と脅され、退職したら本当に約2000万円の
賠償請求訴訟を起こされた会社員がいたことが2011年5月、話題になった。

その後、会社はこの社員から反訴され、残業代未払いで逆に1100万円余の損害賠償を命じる
判決を言い渡されていたことが分かった。

元社員男性（34）の代理人をしている塩見卓也弁護士のツイッターによると、京都市内のシステム
開発会社は、賠償請求の理由について、「従業員モチベーション低下数値」という数字を挙げていた。

真意は不明だが、男性が辞めて会社に残った社員のモチベーションが下がったということらしい。

これに対し、男性は、過労死レベルの労働だったにもかかわらず、残業代などが支給されて
いなかったとして、会社に未払い分など約1600万円の支払いを求め、京都地裁に反訴していた。
男性は2001～09年まで会社のSEをしていたが、一定時間を「働いた時間」とみなし、残業代が
支払われない裁量労働制を不当に適用されていたというのだ。

そして、報道などによると、京都地裁の大島真一裁判官は11年10月31日、会社の請求はすべて棄却。
会社側は仕事の進め方を男性に委ねる一方で、1日の労働時間を8時間ととみなし、残業代を支給
しなかったとし、会社に未払い分1136万円を男性に支払うよう命じる判決を言い渡した。（つづく）

◇「退職の自由」の侵害は認められず

大島裁判官は、男性の仕事には、裁量労働制対象外の営業・プログラミング業務や本人の裁量でない
ノルマなどがあったと指摘した。男性が手元に持っていた日報などから、07年から時間外手当の未払い
が568万円あったと認定。さらに、休日・深夜手当も同額あったとして、付加金の支払いも認めた。

ただ、塩見弁護士はこの日のツイッターで、退職の自由の侵害であるとの主張や、会社の請求自体が
濫訴で不法行為だとの主張は退けられたことを明らかにした。

会社側は、請求がすべて棄却されたことなどをどう考えるのか。

京都市内のシステム開発会社では、取材に対し、担当者が出張中で連絡もつかないとし、回答は得られ
なかった。

富士通の制度だな。
１日８時間しか働かなくても１０時間分の給料が貰える。
そのかわり１日１２時間働いても１６時間働いても
１０時間分しかもらえない。

富士通のＳＥで定時で帰れる奴がどれだけいるのか想像すれば、
経営者にとってどれだけおいしい制度か分かるだろ？

ここまで来ると強制労働施設と変わらんなｗ
会社が訴訟を起こしたのも脅迫するためとしか思えんし。
まあそれで逆に金を取られたんだからざまあだが、気の弱い
ヤツだったら自殺していただろ、これ。
