・最近やっと、製薬企業と医師の「付き合い方」が、表立って議論されだしたと思います。（ex.　医学界新聞、『白衣のポケットの中』）わたしも、どのような接し方をしたらよいか悩むところです。基本的には、①患者さんのために、と②社会的公正の二つの軸で考えようと思っていますが。で、ちょっと、古いですが、ＮＥＪＭに以下のような記事がありました↓

この論文の中に、詐欺をはたらいて罰金をとられた製薬メーカーの一覧（？）表が載っています。（正確にはWhistle-Blower-Initiated Federal Pharmaceutical Fraud Cases Settled betwee January 2001 and March 2009.）表の上から順番に下に列挙しますが、日本でも有名なそうそうたる製薬企業がでていますよ。（Warner-Lambertは２回表にでています）

・この論文の最初に"qui tam" actionという言葉がでていました。何のことかよう分かりません。で、知り合いの弁護士さんにe-mailで問い合わせたら、以下のサイトを教えてくれました。

しかし、これ読んでも、よう分かりません。だれか、分かりやすく、日本語で説明してください。

・それは、さておき、わたしの興味あるとこ二点：

①日本の外資系製薬企業のＭＲさんは、上記の問題をどれだけ知っているのでしょうか？興味あるところです。

②なんとかメディカルといった医学商業雑誌やなんとかケアという医学情報のオンラインサービスは、このＮＥＪＭの論文を紹介したでしょうか？また、この論文に載っているようなビッグ・ファーマの詐欺事件を伝えているのでしょうか？（本当は、自分でチェックしていけばわかるのですが、さすがにそこまで暇はありません）わたしの仮説：商業誌は、薬屋さんの広告でもうけているのでしょうから、こういった情報は載せない、または、載せても小さい。・・・誰か、調べてくれませんかね。

・ところで、これに関連して：Taxpayers Against Fraud Education FundというＮＰＯがあって、False Claims Act Legal Centerというのを運営しているようです。そこのsiteが↓

このホームページで、このＮＥＪＭの論文の紹介がありました。また、色んな製薬メーカーが、訴えられて罰金払っているのがのっていますね。で、ここのsiteのqui tamの説明が↓（最初にご紹介したsiteより、こっちの方がわかりやすいかな）

2. What does "qui tam" mean?
The term "qui tam" stands for a longer Latin phrase [qui tam pro domine regis quam pro ipso se] that is translated as "he who brings an action for the king as well as for himself." Qui tam is the technical legal term for the unique mechanism in the federal False Claims Act that allows persons and entities with evidence of fraud against federal programs or contracts to sue the wrongdoer on behalf of the Government.

A qui tam action is one brought under the False Claims Act by a private plaintiff on behalf of the Federal Government (rather than by the Government itself). These actions are sometimes referred to as "whistleblower lawsuits." With qui tam, the Government has the right to intervene and join the action. Or the Government may decline intervention, in which case the private plaintiff may proceed on his own.

There are a number of pronunciations of qui tam. The simplest, most pedestrian sounding, is key tam (rhymes with "ham"). Black's Law Dictionary suggests kweye (rhymes with "eye") tam. Others insist upon kweye tom (like the common name, but often said with an upper crust accent). And some say kwee (rhymes with "key") tam or kwee tom.

・本日も起きるのが遅かったです。もう完全に干物状態です。本日は、オーダリングシステムのデモあり。大体知っているので、特別にどうのということはありません。何はともあれ問題は、価格です。どれくらいの見積もりがでるのやら。

・今月平均在院日数が厳しくなって、なんとか２１日以内にしないと四苦八苦しています。しかし、なんかお金のこと考えたり、患者さんを早く退院さすことを考えたり。これも、管理者の任務でしょうが、なんか、嫌になりますね。お金のことを気にせず、在院日数のことも気にせず、ゆっくりと患者さんと相対した医療をしたいです。ほんと、そろそろ管理職やめようと思っています。
