私設の裁判所

　m3で保険医登録取消処分の取り消しという異例の事態が話題になっている。

　個別指導という官僚による私設裁判所が医師の反感を買っている。

　個別指導は、密室、高圧的、一方的。
　そんな「指導」は悪だ。全くの悪で、叩きつぶすほか無い。議論の余地など無い。

　この「指導」という会議の後に自殺に追い込まれた医師が何人もいる。

　ものすごく成績の悪いサラリーマンがいたとして、上司が叱責してサラリーマンが自殺したとしたらどうなるだろうか。
　どう考えても上司と会社が悪い。サラリーマンの成績が悪いことと自殺に追い込まれることは別だ。

　このような私設裁判所とも言える指導をどうやったらやめさせることが出来るのか。
　それは、政治家の決断が必要だ。
　新医師会長となった原氏は個別指導という悪とどう戦っていくのだろうか。

　県医師会が個別指導に対して有効な手を打たなければ、組織の求心力は失われるばかりだろう。

山梨地裁、小児科医の訴え認める、「行政の裁量にも限度あり」

　みぞべこどもクリニック(山梨県甲府市)院長の溝部達子氏が、保険医療機関の指定取消と保険医登録取消という二つの処分の取り消しを求め、国を提訴していた裁判で、山梨 地裁は3月31日、原告の訴えを認める判決を下した。ただし、国に求めていた損害賠償(10万円)は認められなかった。

　溝部氏は、無診察投薬等で監査を受け、41万7845円(不正請求34万2176円、不当請求7万5669円)、2005年11月に二つの取消処分を受けていた。溝部氏 は同月に提訴、翌2006年2月に裁判所は処分の執行停止を決定している(溝部氏はその後、保険診療を再開)。みぞべこどもクリニックの存続を求めた患者らによる「山梨の 小児医療を考える会」が発足、2万8000人分以上の署名を集め、行政に働きかけるなどの動きもあった。
